KC WebHosting — Terms of Service

Effective Date: December 2, 2025

These Terms of Service (“Terms”) govern your use of hosting services, websites, servers, and any other services provided by KC WebHosting (“we”, “us”, “our”). By creating an account, purchasing services, or using our platform you agree to these Terms.

1. Account Eligibility & Acceptance

You must be at least 18 years old or have legal authority to enter into a contract. By using our services you confirm you are lawfully permitted to do so and that all information you provide is accurate.

2. ZERO-TOLERANCE POLICY — ILLEGAL CONTENT & IMMEDIATE TERMINATION

If you host, distribute, or operate content or services that violate U.S. federal, state, or local law, your account will be terminated immediately. We will ban your account and permanently delete the associated website(s), files, and data without prior warning. We will send an email notification after termination to the account email address explaining the action taken.

No refunds will be provided for accounts terminated for illegal activity. This includes (but is not limited to):

• Malware, ransomware, or distributing tools intended for hacking, unauthorized access, or cyberattacks.
• Phishing pages, credential harvesting, or scams.
• Distribution of illegal pornography or sexual content that violates laws (see Section 3).
• Hosting or distributing child sexual abuse material (CSAM) — immediate termination and law enforcement notification.
• Trafficking in illegal drugs or distribution of instructions for illegal manufacture/distribution.
• Selling, facilitating, or providing services related to illegal weapons, explosives, or components intended for illegal use.
• Hosting stolen or infringing copyrighted material without permission.
• Any content or service that materially facilitates the commission of a crime.

If we reasonably suspect illegal activity, we may preserve logs or data as required by law and may report activity to law enforcement.

3. NO PORN / ADULT CONTENT

KC WebHosting does not permit pornographic, erotic, or other sexually explicit websites or material on our servers. If we discover pornographic content on your account, we will immediately terminate your account and delete the content. No refund will be issued for accounts terminated for hosting pornographic content.

4. Suspension, Termination & Data Deletion

We reserve the right to suspend, restrict, or terminate any account at our sole discretion for violations of these Terms. Where suspension or termination occurs under Sections 2 or 3 (illegal activity or porn), deletion of site data will be immediate and permanent. We are not required to provide prior notice, although we will send a notification email to the account address after the action. You are responsible for maintaining your own backups; we are not responsible for lost files or site data.

5. Refunds & Billing

Our Refund & Return Policy applies. In short: Full refunds are available within the first three (3) days of the initial purchase. After three days, refunds are issued only at KC WebHosting management’s discretion. No refunds will be provided for accounts terminated due to illegal activity or pornographic/explicit content violations.

6. Acceptable Use (Non-Exhaustive)

You may not use KC WebHosting to violate laws, send spam or operate botnets, host infringing content, or operate services that intentionally interfere with other systems or users. We may update this list at any time.

7. Cooperation with Law Enforcement

We cooperate with law enforcement and will disclose account information, logs, and data when legally required. If compelled by valid legal process, we may provide data without prior notice to the account holder.

8. Indemnification & Liability

You agree to indemnify, defend, and hold KC WebHosting harmless from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the service. To the maximum extent permitted by law, KC WebHosting’s liability is limited to direct damages up to the amount you have paid us in the 6 months prior to the claim.

9. Changes to Terms

We may update these Terms at any time. We’ll post the updated Terms on our site and update the Effective Date. Continued use after changes means you accept the revised Terms.

10. Contact & Appeal

If your account was terminated and you believe it was in error, you may contact support@kcwebhosting.us to request a review. Submitting an appeal does not guarantee reversal. Termination for illegal activity or porn is final unless we explicitly state otherwise.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which KC WebHosting operates. Any disputes will be subject to the exclusive jurisdiction of the appropriate state or federal courts.

Summary (Plain English)

• Host illegal content → IMMEDIATE BAN, website deleted, NO REFUND, email notification after the ban.
• Host pornographic sites → IMMEDIATE BAN, website deleted, NO REFUND.
• You get a 3-day full refund window for new purchases; after that refunds are at our discretion (unless termination for illegal content, in which case no refund).
